Lot Restrictions

None.

Minimum Lot Size
Min/Max ADU Size

No minimum size requirements.
Maximum size requirements: JADU: 500 sf.
ADU, 0-1 bedroom: 850 sf. *
ADU, 2 bedrooms: 1,000 sf. *
* May be increased up to 1,200 sf with ADU Exception.

JADU: 1 bedroom maximum; ADU: 2 bedrooms maximum.

Number of ADUs on a Property
1 ADU (attached or detached); *1 JADU on a lot with a detached ADU only (JADU not allowed on a lot with an attached ADU).
* Two ADUs may be allowed on a lot of at least one acre in size with ADU Exception.

ADU Building Height

ADU maximum height: 16 ft. and 1 story, and may be increased up to 30 ft. and 2 stories with ADU Exception.

Setbacks

No minimum required setbacks apply to the conversion of existing structures to ADU. For construction of new ADU buildings:
Front yard setback: The minimum required by the District.
Side and rear yard setbacks: 4 feet minimum required.
Side and rear setbacks must meet fire safety requirements.

Parking Requirements

1 parking space per ADU is required, except if the ADU: 1) is located within ½ mile of public transit; 2) is located within a historic district; 3) is located within one block of a dedicated parking space for car share vehicle; 4) is converted from an existing structure; 5) parking permits are required but not offered to ADU occupant.

Owner Occupancy

Not required for either the primary residence or the ADU/JADU.

Other requirements

A very low-income household (with an annual gross income of 50% or less than the Marin County annual median income) rent restriction is required in order to grant an exemption to the maximum floor area requirement for ADUs (see above) to allow up to a 1,200 square foot ADU.

The ADU/JADU: 1) may not be sold independently of the primary dwelling on the parcel; 2) shall not be rented for less than 30 consecutive days; 3) a permanent foundation shall be required for all ADUs; 4) detached ADUs shall be separated from the primary dwelling and any accessory structures by a min of 3 ft (new construction only); 5) ADU exterior lighting, including landscape lighting, must be dark sky compliant; 6) any tree over 12 inches in circumference removed while constructing an ADU must be replaced by a 24-inch box tree on the project site, unless determined by the Fire Marshal that replacement planting is not feasible; 7)ADU windows that face a side or rear yard of an adjacent property and are located within 15 feet of the shared property line shall be clerestory (minimum of 6.5 feet above the finished floor height), except that this standard does not apply if a structure on the adjacent property does not have any non-clerestory windows on the building elevation that faces the ADU. 8) Fire sprinklers are needed if required for primary residence.

Process

The Planning Department shall consider the application without discretionary review, public notice, or a hearing. The Planning Department shall approve the application if it meets all ADU requirements and standards.

Exceptions

At its discretion, the town council may grant an exception for: 1) the number of ADUs permitted on a lot or parcel to permit two ADUs (parcel must be at least one acre in size); the size of an ADU to increase to 1,200 sq. ft. if the newly constructed ADU is rent restricted for VLI household; 3) the nonconforming floor area for an addition to the primary residence may be increased up to the amount of floor area of the existing/proposed ADU; 4) the ADU height may be increased to two stories with a max building height of 30 ft.; 5) the location standards to allow a newly constructed ADU above an existing first floor; 6) window standards.
